Name change after marriage: passport first or visa first?

After the wedding you have two workable options. Travel on the passport as it is, using the name printed in it for everything. Or get the passport re-issued in the new name first, and then apply for visas and book tickets in that name. What does not work is a mix of the two. With a name change after marriage, the passport and visa question comes down to choosing one name for one trip and getting the order right.

What the passport authority says

The Passport Seva FAQs answer the main points directly.

  • To change your surname in the passport after marriage or divorce, you apply for re-issue of the passport and have the change made in the personal particulars. The portal's "Documents Advisor" lists the papers for your case.
  • If your name has changed, it is "not advisable to travel in your previous name".
  • To have your spouse's name endorsed in your passport, you also apply for re-issue.

Nothing in those answers says that marriage by itself changes the name in your passport. If you have married and continue to use your earlier name, we read them as leaving nothing to correct. How re-issue works, including Tatkaal, is in passport re-issue before a trip.

Option 1: travel in the name already in your passport

This suits a honeymoon or any trip soon after the wedding, and anyone who is keeping their name. It assumes you have not yet changed your name on other records. Once you have, the Passport Seva advice against travelling in a previous name applies to you. Every paper you create for the trip uses the passport name:

  • the visa application form
  • air tickets and hotel reservations
  • travel insurance
  • the cover letter and any employer letter

Your marital status still goes on the form. The Schengen application, for example, has a field for civil status, and the German missions in India list a marriage certificate, if applicable, as proof of it (checklist for a Schengen visa for tourism). So you can apply as a married person in your pre-marriage name. The certificate links you to your spouse, which matters if your spouse is paying for the trip.

Take care with papers issued after the wedding. A new bank account or a wedding invitation may carry the married name. Where a document in the file shows a different surname, enclose the marriage certificate and add one line of explanation. The method is set out in how to handle a name mismatch in visa documents.

Option 2: re-issue the passport first, then apply

Choose this if you have decided to use the new surname and the trip is far enough away. The order we suggest is:

  1. Apply for re-issue with the change of name. Use the Documents Advisor on the Passport Seva portal to see which proof is asked for in your case.
  2. Wait for the new passport. Do not start a visa application on a passport you are about to replace, and do not book in a name you do not yet hold a passport in.
  3. Check the new booklet as soon as it arrives. The name, date of birth and spouse's name should be as you entered them.
  4. Apply for the visa on the new passport, and make every booking in the new name.

The Schengen form has room for the earlier name. Field 2 is headed "Surname at birth (Former family name(s))", and fields 1 to 3 are filled in according to the travel document (EU Visa Code, Annex I). A married applicant with a new passport therefore enters the new surname in field 1 and the former one in field 2. If another country's form asks for other names you have used, declare the earlier name there.

Your older documents will still be in the earlier name for a while. Degree certificates do not change. Bank accounts and the employer's records change only when you ask. Either update the ones the visa file depends on, starting with the bank account, or enclose the marriage certificate to connect the two names.

We have not quoted a processing time for re-issue. The Passport Seva portal is the place to check.

The mix that causes trouble

Problems come from doing half of each option. Tickets booked in the married name while the passport still shows the earlier one. A visa application lodged on the old passport days before applying for re-issue. A form in one name and a bank statement in the other with nothing to connect them.

One working rule prevents all three, and it is our advice, not a quotation from any authority. For any one trip, the passport you will carry, the visa, the ticket and the form should show the same name.

Visas already in your old passport

A re-issued passport raises the question of valid visas in the previous booklet. The answer belongs to the country that issued each visa, so check its official page.

The United States is one example with a published answer. The Department of State says that if your name has legally changed through marriage, divorce or a court-ordered name change, you will need to obtain a new passport. Once you have it, the Department "recommends that you apply for a new U.S. visa to make it easier for you to travel to and from the United States" (U.S. Department of State, visa FAQs). Do not assume that any other country takes the same position.

Is the spouse's name in the passport needed for a visa?

Neither of the visa texts we read for this article, the Schengen form and the German checklist, asks for a spouse's name to be endorsed in the passport. Where proof of marriage is asked for, as on the German checklist, the paper named is the marriage certificate. Passport Seva also states that married applicants for a fresh passport are not required to provide a marriage certificate or joint affidavit. Adding the name is done through re-issue, and another country may ask for something different.

Which option for which couple

  • Trip within a few weeks of the wedding: Option 1. Travel in the passport name and carry the marriage certificate.
  • Name already changed on bank and other records, trip some months away: Option 2, with the passport first.
  • Keeping your name: nothing to re-issue. Enclose the marriage certificate where civil status is asked for.
  • Passport close to expiry anyway: combine the two jobs in one re-issue, then check the new expiry date against the destination's rule in passport validity for travel.
